COURT OF APPEAL SACKS NYAKO

For the second time in thirteen months, Adamawa State Governor, Murtala Nyako has been sacked by a court of law. The Appeal Court sitting in Yola, the state’s capital has ruled that the shadow elections of the Peoples Democratic Party (PDP) through which Nyako emerged as the party’s flag bearer in 2012 was characterised by breach of the constitution, the Electoral Act 2010 as amended, and the provisions of the PDP Constitution.
The court therefore ruled that Governor Murtala Nyako was not duly nominated as stipulated by the provisions of the Electoral Act, the PDP Constitution and the Constitution of the Federal Republic of Nigeria.
In the ruling, Justice Ignatius Igwe, who read the lead judgment stated that the primary election that produced Admiral Nyako (rtd) was an invalid exercise which lacks legal ingredients. The judge accused the PDP, which was joined as a defendant in the suit, of criminal discrimination against Dr. Umar Ardo. .
Though the primaries were declared invalid by the court, the judge noted that the court was constrained by Section 31 sub-Section (1) of the Electoral Act 2010, as amended, to order for a fresh primary election. Justice Igwe pointed out that the evidence before the court proved that the fundamental human rights of Dr. Umar Ardo, who showed interest to participate in the primary election, were trampled upon by denying his supporters nomination forms to participate as delegates.
The judge also stated that Dr Ardo failed to prove to the court that he participated in the primary election in which Nyako was declared winner; he therefore ruled that Ardo lacks the constitutional powers to challenge the outcome of the election since he was not a participant in the controversial primary election.
On the jurisdiction to hear the matter, Justice S. Denton-West held that Section 87, sub-section 4 empowers Federal High Court, state High Court and the FCT High Court to preside over such complaints brought before them. Reacting after the session,  Nyako’s counsel, Ayo Akam, who stood in for Kanu Agabi (SAN) described the ruling as a judgment for democracy.
Dr Ardo, on his part however vowed to approach the Supreme Court as he said the ruling was not based on law, but on language technicality. He said he won four of the five prayers he sought at the appellate court.
“One of the exhibits my counsel tendered before the court was my election result, which shows that I was scored zero. The result was signed by the chairman of the primary election, so, how can the court say that I was not part of the primary election?” Ardo queried.
It will be recalled that Murtala Nyako and his counterparts from Bayelsa, Kogi, Cross River and Sokoto were sacked on January 27, 2012.

NIGERIAN TOP SCAMMER FINALLY CAPTURED BY FBI

A notorious US born Nigerian fraudster who was placed on the United States Federal Bureau of Investigation (FBI) ‘Most Wanted list’ has been captured after eluding authorities for over four years.

Mr. Tobechukwu Enyinna Onwuhara, 33, described as ‘a criminal mind’ by the FBI for stealing $44 million dollars from US banks using sophisticated methods, including stealing bank customers' personal information, Home Equity Lines of Credit details and account numbers, was nabbed in far away Australia.

The FBI did not say how and when Onwuhara was captured but a mug shot of the scammer on its website http://www.fbi.gov/about-us/investigate/cyber/image/onwuhara-captured/view listed him as ‘captured.’

FBI agents say Onwuhara was born in Houston and sent to live with his wealthy Nigerian father, Prince Doris Onwuhara who the Bureau say is a 'well-known con man who made a fortune from the notorious Nigerian 419 scheme' before returning to the United States when he reached his teenage years in 1999.

Having settled in the southern state of Texas, he got a job with US lender, Capital One Financial Corporation where authorities believe he gained insider knowledge on how to work the US financial system.

His first brush with the law happened in April 2002 when he was arrested by Lewisville city police in Lewisville, Texas after police got a tipoff that he may be using stolen identification to steal money from credit card accounts. When police raided his apartment, they found stolen credit card account numbers, fake driver's licenses and materials used to forge identification.

Same year in December in the western state of Seattle, FBI said 'Onwuhara walked into a local bank and tried to max out the cash withdrawal limit on a stolen credit card' but fled the bank when he sensed trouble. He was said to have jumped into a waiting car driven by a friend of his, Abel Nnabue and they led Seattle police on a high-speed chase but were eventually caught when they tried to flee on foot.

Both men were charged, convicted and sentenced to two years in a Seattle prison but spent only eight months of their sentence for good behaviour.

After their release, they relocated to Texas and went low for a while until sometime in 2005 when the real estate market was at an all time high and Home Equity Lines Of Credit loans became available. Though it was harder to steal from Home Equity Lines of Credit, Onwuhara and his co-conspirators found a way around it.

FBI say Onwuhara painstakingly researched home owners credit reports to see if they opened home lines of credit accounts and how much they had available. At this time in the real estate market, it was very common to find homeowners with $300, 000 - $ 400, 000 in home equity.

Onwuhara impersonated such homeowners after learning their passwords and home phone numbers through extensive research.

The Nigerian acquired multiple prepaid phone lines and wireless internet cards to prevent anyone from successfully tracing their numbers. He then also signed up to a spoofing service which allowed a home owner's number appear on the bank representative's caller ID when he called a bank to request a wire transfer from the account to a home owner's regular checking account before the funds are eventually wired to accounts in Asia and then the monies would go to a Hawala in Africa.

'Hawalas' are funds transfer systems that are not regulated instead, they operate on trust. 'Brokers or Hawalanders would take a cut and then transfer the money to an African Bank, eventually returning to a US bank,' according to America's Most Wanted.

Most of the funds returning to the United States came through accounts belonging to Precious Matthews or one of the other conspirators.

Investigators say Onwuhara made most of the calls himself but when an account belonged to a female, he would get his girlfriend, Precious Matthews to make the call while other co-conspirators would be delegated other duties including finding new home owners with equity in their homes.

According to FBI records, Onwuhara and his crew had stolen more than $20 million dollars before the bureau were notified of the scam and by the time the FBI penetrated their well-organized syndicate and learned their identity, they had stolen an additional $20 million dollars.

To learn their identity, the FBI contacted Verizon Wireless, a prepaid wireless company after it learned they were using prepaid internet services provided by the company to log into bank accounts and were able to obtain surveillance videos of three men paying for the service at one of the provider's stores.

In the spring of 2008, the FBI got a break when they also found out that Onwuhara was using a spoofing service and they contacted the provider who made more than 1500 audio recordings available to them. As expected, most of the recordings were conversations between Onwuhara and various bank representatives, but unfortunately for Onwuhara someone from his crew had also used the phone to call a pharmacy pretending to be a doctor and ordered a prescription for Tobechi Onwuhara. This was a huge lead for the FBI. When they ran Onwuhara's name, there was a match in their database where they found out he had been arrested before for bank fraud.

When they matched his photo with the surveillance videos obtained from the telecommunications company, they believed they had their man.

Gradually, they started their investigations and tried to learn the identity of his co-conspirators. This was when they discovered that Onwuhara had left Miami for Nigeria with a brief stopover in New York.

The FBI waited for Onwuhara and his travelling companions to return to the country and decided to stop him at the airport after he had rerouted his ticket several times.

The Bureau said they wanted him to believe he was being questioned as a possible terrorist and he fell for it by giving them information that eventually linked him to the fraud...

BECOME SELF EMPLOYED REGISTER FOR SURE-P

The reduction of the fuel subsidy by the Federal Government in January 2012, as a deliberate policy aimed at conserving and maximizing the oil wealth of Nigeria, generated cries of discontent, fear and worry amongst Nigerians which led to a national strike. In response to the cries of Nigerians, the President announced the Subsidy Reinvestment and Empowerment Programme (SURE-P) to reinvest the Federal Government’s share of the savings arising from the reduction of subsidies on petroleum products into programmes and initiatives that would go a long way to ease the pain of subsidy removal and create a better life for Nigerians.
The programme therefore ensures that the Federal Government’s part of the savings from fuel subsidy removal or reduction is applied on critical infrastructure projects and social safety net programmes that will directly ameliorate the sufferings of Nigerians and mitigate the impact of subsidy removal.
In summary, the 1-year paid internship scheme will help to:

NIGERIAN CUSTOMS ARREST MAN WITH $1.1M

The MMIA Command, Lagos, of the Nigeria Customs Service yesterday arrested a passenger with $1.1 million at the international wing of the Lagos Airport.
The passenger, identified as Professor Ofoegbu Charles Ononuju, allegedly claimed to be the director of AZ Petroleum. The professor was travelling with a passport with registration number A04008969.
According to the customs area comptroller, Mr. Eporwei Charles Edike, the passenger declared the currency both on forms CDF1A and CDF1B, but claimed he was travelling with Kenya Airways flight number QR542 to Kenya to solve a dispute with a Kenya community over oil blocks .
Edike said the passenger and the currency had been handed over to officials of the Economic and Financial Crimes Commission (EFCC) for further investigation.
He explained that, in 2012, the Nigeria Customs Service, MMIA Command, intercepted over $12.1 million from 14 persons who tried to take money out of the country in contravention of extant regulations.
He said the relevant government agency has been collaborating with Customs to ensure that the law takes its course on the matter, adding that the rise in the incidence of arrests of passengers trying to smuggle foreign currency is a fallout of the inter-agency collaboration.
Edike said the Airport customs command raked in over N35 billion as revenue in 2012, a marked improvement over that of 2011, which was N34 billion.
He attributed the increase in revenue to blockage of leakages and cooperation by forwarding and clearing agents on compliance measures introduced by Customs to enhance revenue.
He said the revenue for 2012 could have been more, if not for the one month disruption in operations at Lagos airport which affected cargo and some of the ground-handling companies. He said revenue projection for 2013 could not be ascertained until the headquarters in Abuja communicated to the command.
Meanwhile, motorists plying the Murtala Muhammed International Airport (MMIA) Road yesterday evening experienced heavy traffic jam as policemen embarked on thorough search of motorists. They were looking for kidnappers who allegedly abducted a young woman at the Mafoluku area of Lagos State.
It was gathered revealed that the woman, who was simply identified as Aisha and whose age could not be ascertained as at the time of filing in this report, was kidnapped around 4:40pm at Mafoluku, a residential area very close to the airport.
The woman was said to have been driving in a black jeep before she was abducted. She was allegedly bundled into the car booth of the kidnappers’ vehicle before they sped off.
Immediately the kidnapping incident occurred, the police authorities in the state contacted every command to cordon off all strategic areas and search for the kidnappers.
At the airport, the exit points from Mafoluku and Ikeja areas were cordoned off by stern-looking police officers who searched every car on the road.
The deputy commissioner, Airport Command, Mr. Aliru Gwandu, confirmed the incident.
He explained that the kidnapping led to the dispatch of police to strategic positions in the state, but explained that the incident did not happen under his command.
He said, “The information got to the police authorities. The commissioner just called that we should designate our men. A black jeep was snatched. I don’t know the number of people involved. It’s not airport command but happened around the Lagos State Command because it happened around Mafoluku area of the state.”
